These Terms govern your use of BuiltByDe (the “Service”), operated as a sole proprietorship doing business as “BuiltByDe” (“we,” “us”). By using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
You must be at least 18 years old, or 13+ with the consent and supervision of a parent or guardian, to use the Service.
BuiltByDe offers training programs, a workout tracker, a physique-scoring tool, educational content, optional cloud sync, and optional coaching features. Core features are free. Some features or services (such as coaching or score reviews) may require payment.
All content — including programs, the physique score, nutrition estimates, injury information, and cues — is for general informational and educational purposes. We are not providing medical, nutritional, or professional training advice tailored to you. You acknowledge that physical training involves risk of serious injury or death, and YOU VOLUNTARILY ASSUME ALL SUCH RISKS and agree that BuiltByDe is not responsible for any injury, loss, or damage resulting from your use of the Service.
Physiques, testimonials, and scores shown in the app are examples, not promises. Results depend on many factors we don’t control. We make no guarantee of any particular outcome.
Accounts are optional. If you create one, you’re responsible for keeping your login secure and for activity under your account. You may delete your account and all synced data at any time from the Dashboard → Account → “Delete my account.”
If you connect with a coach, you authorize that coach to view your training data. If you act as a coach, you agree to use athlete data only to support their training and to comply with these Terms and our Privacy Policy. We are not a party to any agreement between a coach and an athlete and are not responsible for coaching provided by third parties.
Paid features and services are billed through our payment processor (Stripe) or, for mobile apps, the applicable app store. Prices are shown before purchase. Subscriptions renew until canceled. Refunds are handled according to the policy shown at purchase or the app store’s rules. Taxes may apply.
Don’t misuse the Service: no reverse-engineering, scraping, reselling, interfering with security, uploading unlawful content, or using it to harm others. We may suspend or terminate access for violations.
The Service, its programs, scoring system, content, and branding are owned by BuiltByDe and protected by law. You get a personal, non-transferable, revocable license to use the Service for your own training. The training data you enter remains yours.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILTBYDE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR PERSONAL INJURY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $50 IF YOU PAID NOTHING).
You agree to indemnify and hold BuiltByDe harmless from claims, damages, and expenses arising out of your use of the Service or your violation of these Terms.
We may update the Service and these Terms. We’ll post the new effective date here; continued use after changes means you accept them.
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located there.
